DRAFT ON COMMUNICATIONS

Section 91 of the B.N.A. Act would be amended by adding the three following paragraphs:

91.(X) The technical aspects of telecommunications including radiocommunications and the management of radio frequency spectrum.

91.(Y) The networking and interconnectability beyond the limits of a province of telecommunications [Including interprovincial and international rates thereof.]

First Alternative:

The regulation and distribution, including distribution through all or any telecommunications undertakings in a province, of a national program service as defined from time to time by Parliament, and the establishment and operation of a national institution to provide programming services.

Second Alternative:

The regulation and distribution, including distribution through all or any telecommunications undertakings in a province of programming services provided by a national institution.

Section 92 of the B.N.A. Act would be amended by adding the two following paragraphs:

92.(Y) Telecommunications carrier works and undertakings in the province including telephone, telegraph, cable and radiocommunications but excluding such as are of the following classes:

a) national telecommunications;

b) telecommunications for a national purpose distributed on all or any telecommunications undertakings in the province, including telecommunications for maritime and aeronautical communications, defence or in a national emergency;

c) satellite telecommunications.

92.(Z) Telecommunications works and undertakings providing programming services in the province including the distribution thereof by any means [other than broadcasting] [that is not for educational purposes in the province] but excluding the distribution of non-Canadian programming.
