MEMORANDUM FOR THE PRIME MINISTER

The Constitutional Resolution:

  2. An amendment to incorporate a reference to a divine sanction for rights

1. Procedural Issues

Consideration is being given by Justice Officials and others to several amendments to the Constitutional Resolution that the government might wish to move or give support to if moved by an opposition member. These include:

  • An amendment to provide that section 33, the section recognizing and confirming aboriginal and treaty rights, can only be amended by using the general amending formula;
  • An amendment that would provide that the rights and freedoms guaranteed by the Charter shall be enjoyed equally by men and women;
  • An amendment that would incorporate a reference to God into the Resolution.
